1 – About us

2 – Service availability

We currently deliver to every country in the world, but there are restrictions insofar as we accept orders from specific countries. You can find more information on our Delivery Information page.

3 – Your status

By ordering through our site, you warrant that :

You are legally entitled to enter into “binding” contracts;

  • You are at least 18 years old;
  • You live in one of the countries we serve.

4 – How the contract is concluded between you and us :

In this contract, the term “you” refers to the customer and the term “we” refers to LE CHAUFFE BIBERON.

After placing your order, you will receive an e-mail from us confirming that we have received your order. Please note that this does not constitute acceptance of your order. Your order constitutes an offer addressed to us for the purchase of a Product. All orders are subject to availability and acceptance by us and we will confirm this acceptance by sending you an e-mail confirming shipment of the Product. The contract between us will only be concluded once we have sent you the Dispatch Confirmation.

  • We will not process your order until we have received full payment in accordance with clause 7.
  • In the event of an error on your order, you will be able to correct any error made by e-mail before your order is processed. If your order has already been processed, you will not be able to modify it. If your order has already been shipped, please return the Products in accordance with our Returns Policy.
  • This Contract shall only apply to Products for which We have confirmed shipment in the Shipment Confirmation. We will not be obliged to supply any of the Products which may have formed part of your order until shipment of such Products has been confirmed in a separate Shipment Confirmation.
  • We are entitled to refuse any order made by you for any reason.
  • When you make a request, you certify that all the details provided when requesting goods or services are true and accurate, that you are authorized to use the credit or debit card used to make your request, and that there are sufficient funds to cover the cost of the goods or services. It is your responsibility to inform us of any changes to these details as soon as possible.

5 – Consumer rights

If you are contracting as a consumer, you may cancel a Contract at any time within thirty (14) days from the day after which you received the Products. In this case, you will receive a full refund of the price paid for the Products in accordance with our Returns Policy.

6 – Availability and delivery

Your order will be complete on the delivery date indicated on the Shipping Confirmation or, if no delivery date is specified, within 21 days from the date of the Shipping Confirmation, barring exceptional circumstances.

7 – Prices and payment

  • The price to be paid for the products is that indicated on the website. Shipping costs are shown separately when ordering and must also be paid in advance.

You must make payment by the means chosen on the website and payment will not be deemed to have been made until We have received available funds in respect of the total amount stated on the order.

  • Prices are subject to change without notice but changes will not affect orders we have already accepted.
  • All Products must be paid for by credit or debit card. We accept Visa, Visa Debit and Mastercard. We also accept PayPal payments.
  • The cost of foreign products and services may vary. All advertised prices are subject to change.
  • Only one promotional code may be used per order.

9 – Our responsibility

If we fail to deliver the Products or if the Products we deliver are not what you ordered, are damaged or defective, or if the delivery is of incorrect quantity, our only obligation shall be, at your option, to:

rectify any shortages, missing or incorrect deliveries; or

  • Replace or repair any damaged or defective Product;
  • Refund the amount you paid for the Products in question.
  • We will not be liable to you for any consequential, special or indirect damages, including without limitation loss of revenue, profits, contracts, business or anticipated savings or loss of goodwill, reputation or data.
  • Without prejudice to the foregoing, our sole liability to you under and/or arising out of this Agreement shall not exceed the amount paid by you for the Products.
  • Nothing in this contract shall exclude or limit your legal rights.
  • Any person who is not a party to this Agreement is not authorized to enforce any provision of this Agreement.

10 – Intellectual property rights

All intellectual property rights relating to the Products must be owned by Us.

11 – Indemnity

You agree to indemnify, defend and hold harmless LE CHAUFFE BIBERONits directors, officers, employees, consultants, agents and partners from any and all claims, liability, damages and/or costs from any third party (including, without limitation, legal fees) arising from, without limitation, any breach by you of these terms and conditions, any infringement by you of any intellectual property right or any other right of any person or entity, or any breach by you of any duty of confidentiality or discretion or defamatory statements by you in any form.

12 – Customs duties

If you order on our site to be delivered outside the European Union, these may be subject to customs duties and taxes which will be requested when the package arrives at its destination. You will be responsible for payment of such customs duties and taxes. We have no control over these charges and are unable to predict their amount. Please contact your local customs office for more information before ordering.

  • You must comply with all applicable laws and regulations of the country of destination of the products. We will not be liable for any breach of any of these laws by you.

13 – Written communications

Applicable laws require that certain information or communications we send to you be in writing. When you use our site, you accept that communication with us is mainly electronic. We will contact you by e-mail or provide you with information by publishing notices on our website. For contractual purposes, you accept this electronic means of communication and acknowledge that all contracts, notices, information and other communications that We provide to you electronically comply with legal requirements that such communications be in writing. This condition does not affect your legal rights.

14 – Notices

All notices from you should be sent to contact@le-chauffe-biberon.com. We may send notices to you either by e-mail or to the postal address you provide to us when placing an order, or by any of the means described in clause 13 above. Notices will be deemed received and duly given immediately upon posting on our website, 24 hours after sending an e-mail or three days after the date of mailing of any letter. To prove delivery of the information, it will be sufficient to prove, in the case of a letter, that such a letter was properly addressed, stamped and sent by post and, in the case of an email, that the email was sent to the address given by the addressee.

15 Transfer of rights and obligations

The contract between you and us binds you and us and our respective successors and assigns.

You may not transfer, assign, charge or otherwise dispose of any Contract or any of your rights and obligations under it without our prior written consent.

  • We may transfer, assign, invoice, subcontract or otherwise dispose of a Contract or our rights and obligations under it at any time during the term of the Contract.

16 Events beyond our control

We shall not be liable for any failure to perform, or delay in performing, any of our obligations under a Contract caused by events beyond our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-occurrence, omission or accident beyond our control and includes in particular (without limitation) the following events:

  • Strikes, blockades or other industrial action.
    • Civil disturbance, riot, invasion, terrorist attack or threat, war (declared or not), threat or preparation for war.
    • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
    • Inability to use railroads, boats, aircraft, motorized transport or other means of public or private transport.
    • Inability to use public or private telecommunications networks.
    • Government acts, decrees, laws, regulations or other restrictions.
    • Our obligations under any Contract shall be deemed suspended for the duration of the Force Majeure Event, and We shall be granted an extension of time for performance of the Contract corresponding to the duration of such period. We will do everything in our power to put an end to the Force Majeure Event or to find a solution by which we can fulfill our contractual obligations despite the Force Majeure Event.

17 Waiver

If we fail, at any time during the term of the Agreement, to insist upon strict performance of any of your obligations under this Agreement or any of these terms and conditions, or if we fail to exercise any of our rights or remedies to which we are bound under this Agreement, this will not constitute a waiver of such rights or remedies and will not relieve you of your obligation to comply with such obligations.

A waiver by us of any breach shall not constitute a waiver of any subsequent breach.

  • No waiver of any of these terms and conditions by us shall be effective unless expressly designated as a waiver and communicated to you in writing in accordance with clause 13 above.

18 Divisibility

If any provision of these terms and conditions or any provision of a Contract shall be held by any court of competent jurisdiction to be invalid, illegal or unenforceable to any extent, such provision or condition shall to that extent be severed from the remaining provisions and conditions which shall remain valid to the fullest extent permitted by law.

  • Otherwise, you agree that the clause in question may be rectified and interpreted in such a way as to approximate the original meaning of the clause/sub-clause, in accordance with the law.

19 Entire contract

These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of the Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or written.

We each acknowledge that, in entering into any Contract, neither of us has relied on any representation, undertaking or promise made by the other or arising from any oral or written statement made in the course of negotiations between us prior to such Contract, except as expressly set forth in these terms and conditions.

  • Neither of us shall have any remedy in respect of any misrepresentation made by the other party, whether orally or in writing, prior to the date of any Contract (unless such misrepresentation was made fraudulently) and the other party’s sole remedy shall be breach of contract as provided in these terms and conditions.

20 Our right to modify these terms and conditions

We may revise and amend these Terms and Conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in applicable laws, regulatory requirements and changes in our system capabilities or for any other reason as We may decide in our sole discretion.

You will be subject to the policies and terms and conditions in effect at the time you order products from us, unless a change in said policies or terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders you have previously placed), or if We notify you of the change in said policies or terms and conditions before sending you the Dispatch Confirmation (in which case We reserve the right to assume that you have accepted the change in terms and conditions, unless you specify otherwise within seven working days of your receipt of the Products).

21 Law and jurisdiction

These Terms and Conditions and any separate agreements whereby we provide you with Services shall be governed by and construed in accordance with applicable law.
